新華社北京2月26日(ri)電(dian) 近日(ri),中共中央(yang)辦公廳、國務(wu)院辦公廳印發(fa)(fa)了《關(guan)于全(quan)面(mian)加強危險(xian)化學品安全(quan)生(sheng)產(chan)工作的意見》,并發(fa)(fa)出(chu)通(tong)知(zhi),要求各地區(qu)各部(bu)門(men)結(jie)合實際認真貫徹落(luo)實。

《關于全面加強危險化學(xue)品(pin)安全生產工作(zuo)的意見》全文如下。

為深刻(ke)吸取(qu)一些地(di)區發生(sheng)的重(zhong)特(te)大事故(gu)(gu)教(jiao)訓,舉(ju)一反三,全(quan)(quan)面加強危險化學品安全(quan)(quan)生(sheng)產工(gong)作,有(you)力防(fang)范化解(jie)系(xi)統性安全(quan)(quan)風(feng)險,堅決遏制(zhi)重(zhong)特(te)大事故(gu)(gu)發生(sheng),有(you)效維護(hu)人民群眾生(sheng)命(ming)財產安全(quan)(quan),現提(ti)出如下意見。

一、總體要求

以習近平新(xin)時代中(zhong)國特(te)色社會(hui)主(zhu)義(yi)思(si)想(xiang)為指(zhi)導,全面(mian)貫(guan)徹黨的十(shi)九大和十(shi)九屆二中(zhong)、三中(zhong)、四中(zhong)全會(hui)精神,緊緊圍繞統籌推(tui)進(jin)“五位一體”總(zong)體布局(ju)和(he)協調推進“四個全面(mian)”戰略(lve)布局(ju),堅持總(zong)體國家安全觀,按照高質量發展要求,以防控(kong)(kong)系統(tong)性(xing)安全風(feng)險為(wei)重點,完善(shan)和(he)落實(shi)安全生產(chan)責任(ren)和(he)管理(li)(li)(li)制(zhi)度,建立安全隱(yin)患排(pai)查和(he)安全預防控(kong)(kong)制(zhi)體系,加強(qiang)源頭治(zhi)(zhi)(zhi)理(li)(li)(li)、綜合治(zhi)(zhi)(zhi)理(li)(li)(li)、精準(zhun)治(zhi)(zhi)(zhi)理(li)(li)(li),著力解決基礎性(xing)、源頭性(xing)、瓶頸性(xing)問題,加快實(shi)現(xian)危險化學品安全生產(chan)治(zhi)(zhi)(zhi)理(li)(li)(li)體系和(he)治(zhi)(zhi)(zhi)理(li)(li)(li)能力現(xian)代化,全面(mian)提升安全發展水平,推動安全生產(chan)形勢持續穩定好轉,為(wei)經濟社會發展營造安全穩定環境。

二、強化安全風險管控

(一)深入開展(zhan)安全(quan)風險排(pai)(pai)查(cha)。按(an)照《化(hua)(hua)(hua)工(gong)園(yuan)區(qu)(qu)安全(quan)風險排(pai)(pai)查(cha)治理(li)導(dao)則(試行)》和(he)《危(wei)險化(hua)(hua)(hua)學品(pin)企業(ye)安全(quan)風險隱患(huan)(huan)排(pai)(pai)查(cha)治理(li)導(dao)則》等相關制度規范,全(quan)面開展(zhan)安全(quan)風險排(pai)(pai)查(cha)和(he)隱患(huan)(huan)治理(li)。嚴格落實地(di)方黨委和(he)政府領導(dao)責(ze)任,結合(he)實際細化(hua)(hua)(hua)排(pai)(pai)查(cha)標準(zhun),對(dui)危(wei)險化(hua)(hua)(hua)學品(pin)企業(ye)、化(hua)(hua)(hua)工(gong)園(yuan)區(qu)(qu)或化(hua)(hua)(hua)工(gong)集中區(qu)(qu)(以下簡稱化(hua)(hua)(hua)工(gong)園(yuan)區(qu)(qu)),組織實施精準(zhun)化(hua)(hua)(hua)安全(quan)風險排(pai)(pai)查(cha)評估,分類建立(li)完(wan)善安全(quan)風險數據(ju)庫和(he)信息(xi)管理(li)系(xi)統,區(qu)(qu)分“紅、橙、黃、藍”四級(ji)安全風險(xian)(xian),突出一、二級(ji)重(zhong)大危險(xian)(xian)源和有毒(du)有害、易(yi)燃(ran)易(yi)爆化工(gong)企業(ye),按照“一企一策”、“一園一策”原則,實施最嚴格的治理整(zheng)頓。制(zhi)定實施方案(an),深入組(zu)織開展危險(xian)(xian)化學品安全三年提升行動(dong)。

(二)推進產(chan)業(ye)結構調(diao)整。完善和推動落實(shi)化(hua)工產(chan)業(ye)轉(zhuan)型升級的政策措(cuo)施。嚴格(ge)落實(shi)國家產(chan)業(ye)結構調(diao)整指導目錄,及時修(xiu)訂公布淘汰(tai)落后安全技術工藝、設備目錄,各地區結合實(shi)際制(zhi)定(ding)修(xiu)訂并嚴格(ge)落實(shi)危險(xian)化(hua)學(xue)品(pin)“禁(jin)限(xian)控”目(mu)錄,結(jie)合深化供給(gei)側結(jie)構性改革,依(yi)(yi)法淘汰不符合安(an)全生(sheng)產國(guo)(guo)家標準(zhun)、行業標準(zhun)條件的(de)產能,有(you)效(xiao)防(fang)控風險(xian)。堅持全國(guo)(guo)“一(yi)盤棋”,嚴禁(jin)已(yi)淘汰落后產能異地落戶、辦廠進園,對(dui)違規(gui)批建(jian)、接收(shou)者依(yi)(yi)法依(yi)(yi)規(gui)追究(jiu)責(ze)任。

(三)嚴格標(biao)準規(gui)(gui)范。制(zhi)定化(hua)(hua)(hua)(hua)工(gong)(gong)園區建設(she)標(biao)準、認定條(tiao)件(jian)和(he)管理辦法。整合化(hua)(hua)(hua)(hua)工(gong)(gong)、石化(hua)(hua)(hua)(hua)和(he)化(hua)(hua)(hua)(hua)學(xue)制(zhi)藥等安全(quan)生(sheng)產(chan)標(biao)準,解決(jue)標(biao)準不一致(zhi)問(wen)題,建立健全(quan)危險(xian)化(hua)(hua)(hua)(hua)學(xue)品安全(quan)生(sheng)產(chan)標(biao)準體(ti)系。完善化(hua)(hua)(hua)(hua)工(gong)(gong)和(he)涉及危險(xian)化(hua)(hua)(hua)(hua)學(xue)品的(de)工(gong)(gong)程設(she)計(ji)、施工(gong)(gong)和(he)驗(yan)收標(biao)準。提高化(hua)(hua)(hua)(hua)工(gong)(gong)和(he)涉及危險(xian)化(hua)(hua)(hua)(hua)學(xue)品的(de)生(sheng)產(chan)裝置設(she)計(ji)、制(zhi)造和(he)維護標(biao)準。加(jia)快制(zhi)定化(hua)(hua)(hua)(hua)工(gong)(gong)過程安全(quan)管理導(dao)則和(he)精細化(hua)(hua)(hua)(hua)工(gong)(gong)反應(ying)安全(quan)風險(xian)評估標(biao)準等技術規(gui)(gui)范。鼓勵先(xian)進化(hua)(hua)(hua)(hua)工(gong)(gong)企業對標(biao)國際標(biao)準和(he)國外先(xian)進標(biao)準,制(zhi)定嚴于國家標(biao)準或行業標(biao)準的(de)企業標(biao)準。

三、強化全鏈條安全管理

(四)嚴格安(an)(an)全準入。各地(di)區(qu)要堅持(chi)有(you)所為、有(you)所不(bu)為,確定化(hua)(hua)工產業(ye)發展(zhan)定位,建(jian)立發展(zhan)改革、工業(ye)和(he)信息化(hua)(hua)、自然(ran)資源、生態環境、住(zhu)房城鄉建(jian)設和(he)應急管理等部門參與的化(hua)(hua)工產業(ye)發展(zhan)規劃編制(zhi)協(xie)調(diao)溝通機(ji)制(zhi)。新建(jian)化(hua)(hua)工園區(qu)由省(sheng)級政府組織開展(zhan)安(an)(an)全風險評估(gu)、論證并(bing)完善和(he)落實管控措施。涉(she)及“兩重(zhong)點一重(zhong)大(da)”(重(zhong)點監(jian)管的(de)危(wei)(wei)險(xian)(xian)化(hua)工工藝(yi)、重(zhong)點監(jian)管的(de)危(wei)(wei)險(xian)(xian)化(hua)學(xue)(xue)品(pin)和(he)(he)危(wei)(wei)險(xian)(xian)化(hua)學(xue)(xue)品(pin)重(zhong)大(da)危(wei)(wei)險(xian)(xian)源)的(de)危(wei)(wei)險(xian)(xian)化(hua)學(xue)(xue)品(pin)建(jian)設(she)項目由設(she)區的(de)市級以上(shang)政府相關(guan)部(bu)門(men)聯合(he)建(jian)立安全風險(xian)(xian)防控(kong)機(ji)制(zhi)。建(jian)設(she)內(nei)有化(hua)工園(yuan)區的(de)高新技術產(chan)業(ye)開發區、經濟(ji)技術開發區或獨立設(she)置化(hua)工園(yuan)區,有關(guan)部(bu)門(men)應依據上(shang)下游產(chan)業(ye)鏈完(wan)備性、人才基礎和(he)(he)管理(li)能力等因(yin)素(su),完(wan)善落(luo)實安全防控(kong)措(cuo)施(shi)。完(wan)善并嚴格落(luo)實化(hua)學(xue)(xue)品(pin)鑒定(ding)(ding)評估(gu)與登記有關(guan)規定(ding)(ding),科學(xue)(xue)準確鑒定(ding)(ding)評估(gu)化(hua)學(xue)(xue)品(pin)的(de)物理(li)危(wei)(wei)險(xian)(xian)性、毒性,嚴禁未(wei)落(luo)實風險(xian)(xian)防控(kong)措(cuo)施(shi)就投(tou)入生(sheng)產(chan)。

(五)加強重點(dian)環節安全管控。對現有化(hua)工園區全面開(kai)展評估和(he)達標認(ren)定。對新開(kai)發化(hua)工工藝進行安全性審查。2020年年底(di)前實現涉(she)及“兩重點一重大(da)(da)”的(de)化(hua)工裝置或(huo)儲運(yun)(yun)設施自(zi)動(dong)化(hua)控(kong)(kong)制(zhi)系統(tong)裝備率、重大(da)(da)危(wei)險源(yuan)在線(xian)監(jian)測監(jian)控(kong)(kong)率均(jun)達到100%。加(jia)強全國油(you)(you)氣(qi)(qi)管(guan)(guan)道(dao)(dao)發展規劃與國土(tu)空間、交通(tong)運(yun)(yun)輸等(deng)(deng)其他專項(xiang)規劃銜(xian)接。督(du)促企業大(da)(da)力(li)推進油(you)(you)氣(qi)(qi)輸送(song)管(guan)(guan)道(dao)(dao)完整性管(guan)(guan)理(li)(li),加(jia)快完善油(you)(you)氣(qi)(qi)輸送(song)管(guan)(guan)道(dao)(dao)地(di)理(li)(li)信息(xi)系統(tong),強化(hua)油(you)(you)氣(qi)(qi)輸送(song)管(guan)(guan)道(dao)(dao)高后果(guo)區管(guan)(guan)控(kong)(kong)。嚴格(ge)落(luo)實油(you)(you)氣(qi)(qi)管(guan)(guan)道(dao)(dao)法(fa)定檢(jian)驗制(zhi)度,提升油(you)(you)氣(qi)(qi)管(guan)(guan)道(dao)(dao)法(fa)定檢(jian)驗覆(fu)蓋(gai)率。加(jia)強涉(she)及危(wei)險化(hua)學(xue)(xue)品(pin)的(de)停車場安(an)(an)全管(guan)(guan)理(li)(li),納(na)入信息(xi)化(hua)監(jian)管(guan)(guan)平臺。強化(hua)托運(yun)(yun)、承運(yun)(yun)、裝卸、車輛運(yun)(yun)行等(deng)(deng)危(wei)險貨物運(yun)(yun)輸全鏈條安(an)(an)全監(jian)管(guan)(guan)。提高危(wei)險化(hua)學(xue)(xue)品(pin)儲罐(guan)等(deng)(deng)貯存(cun)設備設計標準。研(yan)究(jiu)建立常(chang)壓危(wei)險貨物儲罐(guan)強制(zhi)監(jian)測制(zhi)度。嚴格(ge)特大(da)(da)型(xing)公(gong)路橋梁、特長公(gong)路隧道(dao)(dao)、飲用水源(yuan)地(di)危(wei)險貨物運(yun)(yun)輸車輛通(tong)行管(guan)(guan)控(kong)(kong)。加(jia)強港口、機場、鐵路站(zhan)場等(deng)(deng)危(wei)險貨物配(pei)套存(cun)儲場所(suo)安(an)(an)全管(guan)(guan)理(li)(li)。加(jia)強相關企業及醫院、學(xue)(xue)校、科研(yan)機構等(deng)(deng)單位危(wei)險化(hua)學(xue)(xue)品(pin)使用安(an)(an)全管(guan)(guan)理(li)(li)。

(六)強化(hua)廢(fei)(fei)(fei)棄危(wei)(wei)(wei)險(xian)化(hua)學(xue)品等(deng)危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)監管(guan)。全(quan)(quan)面開展廢(fei)(fei)(fei)棄危(wei)(wei)(wei)險(xian)化(hua)學(xue)品等(deng)危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)(以下簡稱危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu))排查(cha),對(dui)(dui)屬性不(bu)明的固體(ti)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)進(jin)行鑒(jian)別鑒(jian)定,重點整治(zhi)化(hua)工園(yuan)區、化(hua)工企(qi)業、危(wei)(wei)(wei)險(xian)化(hua)學(xue)品單位等(deng)可能(neng)存(cun)在(zai)的違(wei)規堆存(cun)、隨意(yi)傾倒、私(si)自(zi)填(tian)埋危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)等(deng)問題,確保(bao)危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)貯存(cun)、運輸(shu)、處置(zhi)(zhi)(zhi)(zhi)安(an)全(quan)(quan)。加(jia)快(kuai)制定危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)貯存(cun)安(an)全(quan)(quan)技術(shu)標準。建(jian)立(li)完善危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)由(you)產生到處置(zhi)(zhi)(zhi)(zhi)各環節聯(lian)單制度(du)。建(jian)立(li)部門聯(lian)動、區域協(xie)作(zuo)、重大案件(jian)會商(shang)督辦制度(du),形成覆蓋危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)產生、收集、貯存(cun)、轉(zhuan)移、運輸(shu)、利用、處置(zhi)(zhi)(zhi)(zhi)等(deng)全(quan)(quan)過程的監管(guan)體(ti)系,加(jia)大打擊故意(yi)隱(yin)瞞、偷放(fang)偷排或(huo)違(wei)法違(wei)規處置(zhi)(zhi)(zhi)(zhi)危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)違(wei)法犯罪行為力度(du)。加(jia)快(kuai)危(wei)(wei)(wei)險(xian)廢(fei)(fei)(fei)物(wu)(wu)(wu)(wu)綜(zong)合處置(zhi)(zhi)(zhi)(zhi)技術(shu)裝備研發(fa),合理規劃布點處置(zhi)(zhi)(zhi)(zhi)企(qi)業,加(jia)快(kuai)處置(zhi)(zhi)(zhi)(zhi)設(she)施建(jian)設(she),消(xiao)除處置(zhi)(zhi)(zhi)(zhi)能(neng)力瓶頸。督促企(qi)業對(dui)(dui)重點環保(bao)設(she)施和(he)項目組(zu)織(zhi)安(an)全(quan)(quan)風險(xian)評估論證(zheng)和(he)隱(yin)患(huan)排查(cha)治(zhi)理。

四、強化企業主體責任落實

(七)強(qiang)(qiang)化(hua)法(fa)治措施。積極研(yan)究修改刑法(fa)相(xiang)關(guan)條款,嚴(yan)(yan)格(ge)(ge)責任追(zhui)究。推進制定(ding)危(wei)險化(hua)學(xue)品(pin)安(an)(an)全(quan)(quan)(quan)和危(wei)險貨物運(yun)輸相(xiang)關(guan)法(fa)律,修改安(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)產法(fa)、安(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)產許可證條例(li)等(deng),強(qiang)(qiang)化(hua)法(fa)治力度。嚴(yan)(yan)格(ge)(ge)執行執法(fa)公(gong)示制度、執法(fa)全(quan)(quan)(quan)過程記錄制度和重大(da)執法(fa)決定(ding)法(fa)制審核制度,細化(hua)安(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)產行政處罰自由裁量(liang)標準,強(qiang)(qiang)化(hua)精準嚴(yan)(yan)格(ge)(ge)執法(fa)。落實(shi)職工(gong)及家屬和社(she)會公(gong)眾對(dui)企(qi)業(ye)安(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)產隱(yin)患舉報獎(jiang)勵制度,依法(fa)嚴(yan)(yan)格(ge)(ge)查處舉報案件(jian)。

(八)加大失信約束力度。危(wei)險化學品(pin)(pin)生(sheng)產貯存(cun)企(qi)業主(zhu)要(yao)負責(ze)人(ren)(ren)(ren)(法(fa)(fa)定代(dai)表(biao)人(ren)(ren)(ren))必須認真履責(ze),并作出安(an)全(quan)(quan)承諾;因(yin)未履行安(an)全(quan)(quan)生(sheng)產職(zhi)責(ze)受刑事(shi)處罰或撤職(zhi)處分的,依法(fa)(fa)對(dui)其實施(shi)(shi)職(zhi)業禁入(ru);企(qi)業管(guan)理和技(ji)術團隊(dui)必須具備相應的履職(zhi)能力,做到(dao)責(ze)任(ren)到(dao)人(ren)(ren)(ren)、工(gong)作到(dao)位(wei),對(dui)安(an)全(quan)(quan)隱患排查治(zhi)理不(bu)力、風險防控措施(shi)(shi)不(bu)落實的,依法(fa)(fa)依規(gui)追究相關責(ze)任(ren)人(ren)(ren)(ren)責(ze)任(ren)。對(dui)存(cun)在以隱蔽、欺騙或阻(zu)礙等(deng)方(fang)式逃(tao)避(bi)、對(dui)抗安(an)全(quan)(quan)生(sheng)產監管(guan)和環境保護監管(guan),違章指揮、違章作業產生(sheng)重(zhong)大安(an)全(quan)(quan)隱患,違規(gui)更改工(gong)藝(yi)流程(cheng),破壞監測監控設施(shi)(shi),夾帶、謊報(bao)、瞞報(bao)、匿報(bao)危(wei)險物品(pin)(pin)等(deng)嚴重(zhong)危(wei)害人(ren)(ren)(ren)民(min)群眾生(sheng)命財產安(an)全(quan)(quan)的主(zhu)觀故(gu)意行為的單位(wei)及主(zhu)要(yao)責(ze)任(ren)人(ren)(ren)(ren),依法(fa)(fa)依規(gui)將其納入(ru)信用記錄,加強失信懲(cheng)戒,從(cong)嚴監管(guan)。

(九)強化(hua)激勵措施。全面推進危(wei)(wei)(wei)(wei)險(xian)(xian)化(hua)學(xue)品(pin)企(qi)業(ye)安全生(sheng)(sheng)產(chan)(chan)標(biao)準(zhun)化(hua)建(jian)設(she),對(dui)一、二級(ji)標(biao)準(zhun)化(hua)企(qi)業(ye)擴產(chan)(chan)擴能(neng)、進區入(ru)園等(deng),在同(tong)等(deng)條件下分(fen)別給予優(you)先考慮并減少檢查頻次。對(dui)國家鼓勵發展的(de)危(wei)(wei)(wei)(wei)險(xian)(xian)化(hua)學(xue)品(pin)項(xiang)目,在投資(zi)總額內(nei)進口的(de)自(zi)用先進危(wei)(wei)(wei)(wei)險(xian)(xian)品(pin)檢測檢驗(yan)設(she)備按照(zhao)現(xian)行(xing)政策規定免(mian)征(zheng)進口關稅(shui)。落實安全生(sheng)(sheng)產(chan)(chan)專(zhuan)用設(she)備投資(zi)抵(di)免(mian)企(qi)業(ye)所(suo)得稅(shui)優(you)惠(hui)。提高危(wei)(wei)(wei)(wei)險(xian)(xian)化(hua)學(xue)品(pin)生(sheng)(sheng)產(chan)(chan)貯存(cun)企(qi)業(ye)安全生(sheng)(sheng)產(chan)(chan)費用提取(qu)標(biao)準(zhun)。推動危(wei)(wei)(wei)(wei)險(xian)(xian)化(hua)學(xue)品(pin)企(qi)業(ye)建(jian)立安全生(sheng)(sheng)產(chan)(chan)內(nei)審(shen)機制(zhi)和承諾制(zhi)度,完善(shan)風險(xian)(xian)分(fen)級(ji)管控和隱患排查治理預防機制(zhi),并納(na)入(ru)安全生(sheng)(sheng)產(chan)(chan)標(biao)準(zhun)化(hua)等(deng)級(ji)評(ping)審(shen)條件。

五、強化基礎支撐保障

(十)提高科技與信(xin)(xin)息化(hua)(hua)(hua)(hua)(hua)水平(ping)。強(qiang)化(hua)(hua)(hua)(hua)(hua)危(wei)險化(hua)(hua)(hua)(hua)(hua)學品(pin)安(an)全(quan)(quan)(quan)研究支(zhi)撐(cheng),加強(qiang)危(wei)險化(hua)(hua)(hua)(hua)(hua)學品(pin)安(an)全(quan)(quan)(quan)相(xiang)關國家(jia)級(ji)科技創新平(ping)臺(tai)建設(she)(she),開展基礎(chu)(chu)性(xing)、前(qian)瞻性(xing)研究。研究建立危(wei)險化(hua)(hua)(hua)(hua)(hua)學品(pin)全(quan)(quan)(quan)生命(ming)周期信(xin)(xin)息監(jian)管(guan)系統(tong),綜合(he)利用(yong)電子(zi)標簽、大(da)數據、人工智能(neng)等(deng)高新技術(shu),對(dui)生產(chan)、貯存、運輸、使用(yong)、經營、廢棄處(chu)(chu)置等(deng)各環節進行(xing)(xing)全(quan)(quan)(quan)過程信(xin)(xin)息化(hua)(hua)(hua)(hua)(hua)管(guan)理和(he)監(jian)控(kong)(kong)(kong),實現(xian)(xian)危(wei)險化(hua)(hua)(hua)(hua)(hua)學品(pin)來源可循、去向可溯、狀態可控(kong)(kong)(kong),做到企業(ye)、監(jian)管(guan)部(bu)門、執法部(bu)門及(ji)應(ying)急救援部(bu)門之間互聯互通。將安(an)全(quan)(quan)(quan)生產(chan)行(xing)(xing)政處(chu)(chu)罰信(xin)(xin)息統(tong)一(yi)納入監(jian)管(guan)執法信(xin)(xin)息化(hua)(hua)(hua)(hua)(hua)系統(tong),實現(xian)(xian)信(xin)(xin)息共(gong)享,取代層層備(bei)案。加強(qiang)化(hua)(hua)(hua)(hua)(hua)工危(wei)險工藝本質安(an)全(quan)(quan)(quan)、大(da)型儲罐安(an)全(quan)(quan)(quan)保障(zhang)、化(hua)(hua)(hua)(hua)(hua)工園(yuan)區(qu)安(an)全(quan)(quan)(quan)環保一(yi)體化(hua)(hua)(hua)(hua)(hua)風險防控(kong)(kong)(kong)等(deng)技術(shu)及(ji)裝備(bei)研發。推進化(hua)(hua)(hua)(hua)(hua)工園(yuan)區(qu)安(an)全(quan)(quan)(quan)生產(chan)信(xin)(xin)息化(hua)(hua)(hua)(hua)(hua)智能(neng)化(hua)(hua)(hua)(hua)(hua)平(ping)臺(tai)建設(she)(she),實現(xian)(xian)對(dui)園(yuan)區(qu)內企業(ye)、重(zhong)點場所、重(zhong)大(da)危(wei)險源、基礎(chu)(chu)設(she)(she)施實時風險監(jian)控(kong)(kong)(kong)預警。加快(kuai)建成應(ying)急管(guan)理部(bu)門與轄區(qu)內化(hua)(hua)(hua)(hua)(hua)工園(yuan)區(qu)和(he)危(wei)險化(hua)(hua)(hua)(hua)(hua)學品(pin)企業(ye)聯網的遠(yuan)程監(jian)控(kong)(kong)(kong)系統(tong)。

(十一(yi))加強專(zhuan)業(ye)(ye)人(ren)(ren)才(cai)培(pei)(pei)養。實施安(an)(an)全(quan)技能(neng)提(ti)升行(xing)動(dong)計劃(hua),將(jiang)化(hua)(hua)工(gong)(gong)、危(wei)險(xian)化(hua)(hua)學(xue)(xue)品企(qi)業(ye)(ye)從(cong)業(ye)(ye)人(ren)(ren)員作為高危(wei)行(xing)業(ye)(ye)領域職(zhi)業(ye)(ye)技能(neng)提(ti)升行(xing)動(dong)的重點(dian)群(qun)體(ti)。危(wei)險(xian)化(hua)(hua)學(xue)(xue)品生(sheng)產(chan)企(qi)業(ye)(ye)主(zhu)要(yao)負責人(ren)(ren)、分管安(an)(an)全(quan)生(sheng)產(chan)負責人(ren)(ren)必(bi)須具有(you)化(hua)(hua)工(gong)(gong)類專(zhuan)業(ye)(ye)大(da)專(zhuan)及以上(shang)學(xue)(xue)歷和一(yi)定實踐經驗(yan),專(zhuan)職(zhi)安(an)(an)全(quan)管理人(ren)(ren)員至少要(yao)具備中級及以上(shang)化(hua)(hua)工(gong)(gong)專(zhuan)業(ye)(ye)技術職(zhi)稱或(huo)化(hua)(hua)工(gong)(gong)安(an)(an)全(quan)類注冊安(an)(an)全(quan)工(gong)(gong)程師資格,新(xin)招(zhao)一(yi)線崗位從(cong)業(ye)(ye)人(ren)(ren)員必(bi)須具有(you)化(hua)(hua)工(gong)(gong)職(zhi)業(ye)(ye)教育背(bei)景或(huo)普通高中及以上(shang)學(xue)(xue)歷并接受危(wei)險(xian)化(hua)(hua)學(xue)(xue)品安(an)(an)全(quan)培(pei)(pei)訓(xun),經考(kao)核(he)合格后(hou)方能(neng)上(shang)崗。企(qi)業(ye)(ye)通過(guo)(guo)內部培(pei)(pei)養或(huo)外部聘(pin)用形式建(jian)(jian)立化(hua)(hua)工(gong)(gong)專(zhuan)業(ye)(ye)技術團隊。化(hua)(hua)工(gong)(gong)重點(dian)地區(qu)扶持建(jian)(jian)設一(yi)批(pi)化(hua)(hua)工(gong)(gong)相關職(zhi)業(ye)(ye)院校(含技工(gong)(gong)院校),依托(tuo)重點(dian)化(hua)(hua)工(gong)(gong)企(qi)業(ye)(ye)、化(hua)(hua)工(gong)(gong)園區(qu)或(huo)第三方專(zhuan)業(ye)(ye)機構建(jian)(jian)立實習實訓(xun)基地。把化(hua)(hua)工(gong)(gong)過(guo)(guo)程安(an)(an)全(quan)管理知識納入相關高校化(hua)(hua)工(gong)(gong)與制藥類專(zhuan)業(ye)(ye)核(he)心課程體(ti)系。

(十二(er))規范技術(shu)服務(wu)(wu)協作機(ji)制(zhi)。加快(kuai)培育(yu)一批專業(ye)能(neng)力強、社會信譽好的技術(shu)服務(wu)(wu)龍頭企(qi)(qi)業(ye),引入市場機(ji)制(zhi),為(wei)涉(she)及危(wei)險化(hua)學(xue)品企(qi)(qi)業(ye)提供(gong)管理(li)和技術(shu)服務(wu)(wu)。建立專家技術(shu)服務(wu)(wu)規范,分(fen)級分(fen)類開展(zhan)精準指導幫扶。安(an)全生產責(ze)(ze)任(ren)保險覆蓋所有危(wei)險化(hua)學(xue)品企(qi)(qi)業(ye)。對安(an)全評(ping)價(jia)、檢(jian)(jian)測檢(jian)(jian)驗等中介(jie)機(ji)構(gou)(gou)和環境評(ping)價(jia)文件(jian)編制(zhi)單位出具虛假(jia)報告和證明(ming)的,依法依規吊(diao)銷其相關資質或資格;構(gou)(gou)成犯罪(zui)的,依法追究刑事(shi)責(ze)(ze)任(ren)。

(十三(san))加(jia)(jia)強危險化(hua)(hua)(hua)學(xue)品救(jiu)(jiu)援隊伍建設。統(tong)籌國家(jia)綜合性(xing)消防救(jiu)(jiu)援力(li)(li)量、危險化(hua)(hua)(hua)學(xue)品專業救(jiu)(jiu)援力(li)(li)量,合理規劃(hua)布局(ju)建設立足化(hua)(hua)(hua)工園(yuan)區、輻射周邊、覆蓋主要貯存區域(yu)的(de)危險化(hua)(hua)(hua)學(xue)品應(ying)急救(jiu)(jiu)援基(ji)地。強化(hua)(hua)(hua)長江干線危險化(hua)(hua)(hua)學(xue)品應(ying)急處置能力(li)(li)建設。加(jia)(jia)強應(ying)急救(jiu)(jiu)援裝備(bei)配備(bei),健全應(ying)急救(jiu)(jiu)援預案,開展實訓演(yan)練,提(ti)高(gao)區域(yu)協同(tong)救(jiu)(jiu)援能力(li)(li)。推進實施危險化(hua)(hua)(hua)學(xue)品事故應(ying)急指南(nan),指導企業提(ti)高(gao)應(ying)急處置能力(li)(li)。

六、強化安全監管能力

(十四)完(wan)善監(jian)管(guan)體(ti)制(zhi)機制(zhi)。將涉(she)(she)恐涉(she)(she)爆涉(she)(she)毒危險化學品重大(da)風險納(na)入國(guo)家安全管(guan)控范圍,健全監(jian)管(guan)制(zhi)度(du),加(jia)強重點監(jian)督(du)。進一(yi)步調整完(wan)善危險化學品安全生產監(jian)督(du)管(guan)理(li)體(ti)制(zhi)。按(an)照“管(guan)(guan)(guan)行(xing)(xing)業必須管(guan)(guan)(guan)安(an)(an)(an)全(quan)(quan)、管(guan)(guan)(guan)業務必須管(guan)(guan)(guan)安(an)(an)(an)全(quan)(quan)、管(guan)(guan)(guan)生產(chan)經(jing)營必須管(guan)(guan)(guan)安(an)(an)(an)全(quan)(quan)”和(he)“誰(shui)主管(guan)(guan)(guan)誰(shui)負責(ze)”原則,嚴格(ge)落實相(xiang)關(guan)(guan)部(bu)(bu)門(men)危(wei)(wei)險(xian)(xian)化學品(pin)(pin)各(ge)環節安(an)(an)(an)全(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)責(ze)任,實施全(quan)(quan)主體、全(quan)(quan)品(pin)(pin)種、全(quan)(quan)鏈(lian)條(tiao)安(an)(an)(an)全(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)。應(ying)急管(guan)(guan)(guan)理(li)(li)部(bu)(bu)門(men)負責(ze)危(wei)(wei)險(xian)(xian)化學品(pin)(pin)安(an)(an)(an)全(quan)(quan)生產(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)工(gong)(gong)作(zuo)和(he)危(wei)(wei)險(xian)(xian)化學品(pin)(pin)安(an)(an)(an)全(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)綜(zong)合(he)工(gong)(gong)作(zuo);按照《危(wei)(wei)險(xian)(xian)化學品(pin)(pin)安(an)(an)(an)全(quan)(quan)管(guan)(guan)(guan)理(li)(li)條(tiao)例》規定,應(ying)急管(guan)(guan)(guan)理(li)(li)、交通運(yun)輸(shu)、公安(an)(an)(an)、鐵路(lu)、民航、生態環境等部(bu)(bu)門(men)分(fen)別承(cheng)擔(dan)危(wei)(wei)險(xian)(xian)化學品(pin)(pin)生產(chan)、貯存(cun)、使用(yong)、經(jing)營、運(yun)輸(shu)、處(chu)置等環節相(xiang)關(guan)(guan)安(an)(an)(an)全(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)責(ze)任;在相(xiang)關(guan)(guan)安(an)(an)(an)全(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)職(zhi)責(ze)未明確部(bu)(bu)門(men)的(de)情(qing)況下,應(ying)急管(guan)(guan)(guan)理(li)(li)部(bu)(bu)門(men)承(cheng)擔(dan)危(wei)(wei)險(xian)(xian)化學品(pin)(pin)安(an)(an)(an)全(quan)(quan)綜(zong)合(he)監(jian)(jian)(jian)督(du)管(guan)(guan)(guan)理(li)(li)兜底責(ze)任。生態環境部(bu)(bu)門(men)依(yi)法對(dui)危(wei)(wei)險(xian)(xian)廢物的(de)收集、貯存(cun)、處(chu)置等進行(xing)(xing)監(jian)(jian)(jian)督(du)管(guan)(guan)(guan)理(li)(li)。應(ying)急管(guan)(guan)(guan)理(li)(li)部(bu)(bu)門(men)和(he)生態環境部(bu)(bu)門(men)以及(ji)其他有(you)(you)關(guan)(guan)部(bu)(bu)門(men)建立監(jian)(jian)(jian)管(guan)(guan)(guan)協作(zuo)和(he)聯合(he)執法工(gong)(gong)作(zuo)機(ji)制,密(mi)切(qie)協調配(pei)合(he),實現信息及(ji)時、充分(fen)、有(you)(you)效共享,形成工(gong)(gong)作(zuo)合(he)力,共同做(zuo)好(hao)危(wei)(wei)險(xian)(xian)化學品(pin)(pin)安(an)(an)(an)全(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)各(ge)項工(gong)(gong)作(zuo)。完(wan)善國務院安(an)(an)(an)全(quan)(quan)生產(chan)委員會(hui)工(gong)(gong)作(zuo)機(ji)制,及(ji)時研究解決危(wei)(wei)險(xian)(xian)化學品(pin)(pin)安(an)(an)(an)全(quan)(quan)突(tu)出問題(ti),加強對(dui)相(xiang)關(guan)(guan)單(dan)位履職(zhi)情(qing)況的(de)監(jian)(jian)(jian)督(du)檢(jian)查和(he)考核通報。

(十五)健全(quan)執法體系。建立健全(quan)省、市、縣(xian)三級安全(quan)生產(chan)執法體系。省級應急管(guan)理部門原則上不設執法隊伍,由(you)內設機(ji)構承擔安全(quan)生產(chan)監管(guan)執法責任,市、縣(xian)級應急管(guan)理部門一般實行“局隊合一”體制。危險(xian)化(hua)學品(pin)(pin)重點縣(xian)(市(shi)、區(qu)、旗)、危險(xian)化(hua)學品(pin)(pin)貯(zhu)存量大的(de)港區(qu),以及各類開發區(qu)特別是內設化(hua)工園區(qu)的(de)開發區(qu),應強(qiang)化(hua)危險(xian)化(hua)學品(pin)(pin)安全生產監(jian)管職責,落(luo)實落(luo)細監(jian)管執法(fa)責任,配(pei)(pei)齊配(pei)(pei)強(qiang)專業執法(fa)力(li)量。具體由地方黨委和政府(fu)研究確定,按程序審(shen)批。

(十六)提升監管效能。嚴(yan)把危(wei)險化學品監管執法人(ren)(ren)員(yuan)進人(ren)(ren)關,進一步明確資格標準,嚴(yan)格考試考核(he),突出(chu)專(zhuan)業(ye)素質,擇優錄用;可通過公(gong)務(wu)員(yuan)聘(pin)任(ren)制方式選聘(pin)專(zhuan)業(ye)人(ren)(ren)才(cai),到2022年(nian)年(nian)底具(ju)有安全(quan)生產相關專業學歷和實(shi)踐經驗(yan)的執(zhi)法人(ren)(ren)員(yuan)數量不低于在職人(ren)(ren)員(yuan)的75%。完善監(jian)(jian)管執(zhi)法人(ren)(ren)員(yuan)培(pei)訓(xun)制度(du),入職培(pei)訓(xun)不少(shao)于3個月,每年(nian)參加為(wei)期不少(shao)于2周的復訓(xun)。實(shi)行危險(xian)化學品(pin)重(zhong)(zhong)點縣(市、區、旗)監(jian)(jian)管執(zhi)法人(ren)(ren)員(yuan)到國有大型化工(gong)企(qi)業進(jin)行崗位實(shi)訓(xun)。深化“放管服”改革,加強和規范事中事后監(jian)(jian)管,在對(dui)涉及(ji)(ji)危險(xian)化學品(pin)企(qi)業進(jin)行全(quan)覆蓋監(jian)(jian)管基礎上(shang),實(shi)施分級(ji)分類動(dong)態嚴(yan)(yan)格監(jian)(jian)管,運用“兩隨機一公開”進(jin)行重(zhong)(zhong)點抽(chou)查、突擊檢查。嚴(yan)(yan)厲打擊非(fei)法建設生產經營行為(wei)。省、市、縣級(ji)應急管理部門對(dui)同一企(qi)業確定一個執(zhi)法主體,避免多(duo)層多(duo)頭重(zhong)(zhong)復執(zhi)法。加強執(zhi)法監(jian)(jian)督,既嚴(yan)(yan)格執(zhi)法,又避免簡單化、“一刀切”。大力推行“互(hu)聯網+監(jian)(jian)管”、“執(zhi)法+專家”模式,及(ji)(ji)時發現(xian)風險(xian)隱(yin)患,及(ji)(ji)早預(yu)警防范。各地區根據工(gong)作需要,面向社會招(zhao)聘(pin)執(zhi)法輔助(zhu)人(ren)(ren)員(yuan)并健全(quan)相關管理制度(du)。

各(ge)地區(qu)各(ge)有關(guan)部門要加強組(zu)織領(ling)導,認真落實(shi)黨政(zheng)同責、一崗雙責、齊抓共管(guan)、失職追責安(an)全生產責任制,整(zheng)合一切(qie)條件、盡(jin)最大努力,加快推進危(wei)險(xian)化(hua)學品安(an)全生產各(ge)項工(gong)作措施落地見(jian)效,重要情況及時向黨中央、國務院報告。
